On its own merits, however, it is groundbreaking collection of essays on key themes, issues and concepts in contemporary moral theology and Christian ethics. This is Thomas Aquinas's position in the seminal article on the natural law, Summa theologiae I-II, question 94, article 2, where, (...) citing Aristotle, he formulates the principle as, "One should not simultaneously affirm and negate." Lafter in the same article, Thomas offers a practical formulation of the same principle, "Good is to be done and pursued and evil avoided"; but in law, since it is contained in propositions (airmations and negations) as distinct from ideas regarding the pursuit of goods, the prior formulation is the more immediately relevant of the two.The book under review is important in that, by going through the legal history regarding abortion and related issues in a number of different countries—the United States, Canada, Italy, Spain, Poland, Ireland (Eire), Costa Rica, Argentina, Chile, Mexico, and Peru—it causes to emerge any number of times the realization that legislation and judicial decisions in favor of abortion "rights" invariably infect a legal system with contradictions and inconsistencies of various sorts. The present essay is, therefore, not your typical book review. Its objective is simply to list some of the legal contradictions and inconsistencies identified by the book's various authors as they describe the legal status of the unborn in their respective nations. [End Page 1323]William Saunders's very clear and comprehensive first chapter is entitled, "Judicial Interference in the Protection of Human Life in the United States: Actions and Consequences." In it, he describes, among other things, the Human Cloning Prohibition Act passed by the U.S. House of Representatives in 2003, which prohibited "any person or entity, public or private" from performing human cloning (23). He speaks also of a bill proposed in the U.S. Senate once the Human Cloning Prohibition Act had passed in the House of Representatives. This Senate bill (which was entitle, "The Human Cloning Ban and Stem Cell Research Protection Act") would have prohibited "any person or other legal entity" from conducting human cloning, even while allowing nuclear transplantation, which it defines as "transferring the nucleus of a human somatic cell into an oocyte from which the nucleus... ha[s] been... removed or rendered inert." The problem here, as Saunders explains, is that this latter definition "is the very definition of cloning" (25). In other words, in the same year, two pieces of legislation were considered in the Congress of the United States, both purporting to ban human cloning, one of which would have permitted what the other described (correctly) as human cloning and so prohibited.In the second chapter, "Whither United States Abortion Law?" by Gerard V. Bradley, discussed, among other things, is the inconsistency between the United States Supreme Court's pro-abortion decision Roe v. Wade and various laws, both state and federal, prohibiting feticide. Bradley says of the 2004 federal Unborn Victims of Violence Act that, "in pertinent part it says that 'whoever' 'causes the death of or bodily injury to,' a 'child who is in utero' is guilty of an offense apart from any accompanying offense against the woman carrying the child." The penalty for such an act is the same as would be imposed if the act were inflicted upon the unborn child's mother: if, for instance, the mother was killed. "A child in utero," reports Bradley, "is defined as a member of the species homo sapiens, at any stage of development, who is carried in the womb'" (37).The problem here is that prosecutable under this law are acts identical with those performed legally by abortionists. Bradley mentions two cases in which a woman's male partner—in one case the woman's husband—effected by stealth the abortion of her child. In lieu of an abstract, here is a brief excerpt of the content:RECENT SACRAMENTAL THEOLOGY HIS ARTICLE continues and complements an earlier scussion of contemporary sacramental method pubhed in October, 1983, based on a review of eleven books published in English on the sacraments from 1975 to 1983.1 That article dealt specifically with approaches to "contemporary systematic reflection on the Christian sacraments, the relation of sacramental theology to other areas of theology, the impact of liturgical studies on sacramental studies, and (...) aspects of pastoral practice." 2 The final section described the elements that should be included in a contemporary approach to a systematic study of sacraments.3 The present article assesses seven more recent works in English on sacraments in general,4 again from the perspective of method. This is a vital move in the postconciliar church. It is as though we feel that we have enough sense of the shifting sands of time to use them in an hourglass to mark our age.5 Each of the books discussed here can be understood to propose a new general theory of sacramental life or a new approach to the systematic study of sacraments. The works by Cooke and Schanz are clearly intended as texts for college courses in sacramental theology. Martos's book offers an interdisciplinary approach to sacraments. James White offers a fresh look at the traditional dictum lex orandi, lex credendi on a level useful for pastors and seminary students. Gerard Fourez approaches sacraments from a social science perspective. David Power deals with symbol in liturgy and the relationship between sacramental study and contemporary culture. Patricia Smith offers a way of dealing with how to teach about sacraments in the contemporary context of evolving sacramental theories. Each book can be understood as an attempt to chart a path through the shifting sands of theological method, liturgical reform and the varying approaches to sacramental theology in the past two decades. Well known for his books Christian Sacraments and Christian Personality (1965) and Ministry to Word and Sacrament (1976), Bernard Cooke presents an.approach in Sacraments and Sacramentality that is grounded in human experience and everyday life. The first six chapters demonstrate how Christian sacraments are grounded in human life; the remaining chapters discuss individual sacraments and sacramental grace. Cooke states that Christian sacraments are "specially significant realities that are meant to transform the reality of the human by somehow bringing persons into closer contact with the.saving action of Jesus" (8). Theories of scientific rationality typically pertain to belief. In this paper, the author argues that we should expand our focus to include motivations as well as belief. An economic model is used to evaluate whether science is best served by scientists motivated only by truth, only by credit, or by both truth and credit. In many, but not all, situations, scientists motivated by both truth and credit should be judged as the most rational scientists.

Husserl seems to have devoted roughly equal amounts of energy and pages to the description of perception, judgement, and imagination. By “description,” he meant the analysis of the traits and components of mental states or acts and their objects. As his views changed over the years about the nature of intentionality and philosophy, the descriptive psychology of the Logical Investigations (1900/01) gave way to descriptive programmes in which the objects of perception and of judgement were conceived of in terms of (...) a new, analytic framework; in particular Husserl lost interest in describing the things and processes in the real world that are the objects of perception and judgement and so too in describing their relations to these acts. His new analytic framework, particularly as it applies to perception, has been thoroughly expounded and discussed in the literature. My aim here is to expound Husserl's first descriptions of perception within the framework of the Investigations and to incorporate as far as possible his later descriptive results to the extent that these are separable from his later turn to idealism. Classical theories of truth are monistic, since they fundamentally search for the essence of truth. The correspondence theory of truth is the most representative in this regard. There are several difficulties with the essentialist theories of truth, which led to the emergence of several alternatives. The purpose of this article is to critically evaluate three of them: the pragmatic theory of truth, the deflationary theory and the pluralistic approach. I argue for overcoming monism and for accepting pluralism in our understanding (...) of truth. At the same time, I argue – from a wittgensteinian point of view – for abandoning the attempt to build a general philosophical theory of truth. I plead for limiting the philosopher’s role to the clarification of the specific ways in which the concept of truth is used in various forms of life and areas of scientific investigation. Multiple uses of the concept of truth in different thematic areas cannot be synthesized, properly speaking, through a particular philosophical theory. (shrink)

In seeking to explain the evolution of social cooperation, many scholars are using increasingly complex game-theoretic models. These complexities often model readily observable features of human and animal populations. In the case of previous games analyzed in the literature, these modifications have had radical effects on the stability and efficiency properties of the models. We will analyze the effect of adding spatial structure to two communication games: the Lewis Sender-Receiver game and a modified Stag Hunt game. For the Stag Hunt, (...) we find that the results depart strikingly from previous models. In all cases, the departures increase the explanatory value of the models for social phenomena. (shrink)

The present volume is devoted to philosophical reflection on the nature of paradise. Our contribution to this larger project is an extension of previous work that we’ve done on the nature of human agency and virtue in heaven. Here, we’d like to focus on three things. First, we will discuss in greater detail what it is we mean by “growth in virtue.” Second, we will answer a number of objections to that understanding of growth in virtue. Third, we will show (...) two benefits of this understanding of growth in virtue. The work of Michael Oakeshott has retained a striking currency in philosophical discourse about education. This is hardly surprising in view of his influence on Paul Hirst and Richard Peters, two philosophers whose work had an enormous impact on educational thinking and practice in the English-speaking world. And, although much of the detail in educational debate may change, the fundamental underlying concerns regarding the conception of the person, the nature of knowledge and the moral life and their expression in educational (...) institutions and activities remain subject of disagreement. In the light of this continuing interest and of Oakeshott’s extensive writing on so many aspects of education, it is timely that a book be published on his thinking on the subject. (shrink)

Although theories that examine direct links between behavior and brain remain incomplete, it is known that brain expansion significantly correlates with caloric and oxygen demands. Therefore, one of the principles governing evolutionary cognitive neuroscience is that cognitive abilities that require significant brain function (and/or structural support) must be accompanied by significant fitness benefit to offset the increased metabolic demands. One such capacity is self-awareness (SA), which (1) is found only in the greater apes and (2) remains unclear in terms of (...) both cortical underpinning and possible fitness benefit. In the current experiment, transcranial magnetic stimulation (TMS) was applied to the prefrontal cortex during a spatial perspective-taking task involving self and other viewpoints. It was found that delivery of TMS to the right prefrontal region disrupted self-, but not other-, perspective. These data suggest that self-awareness may have evolved in concert with other right hemisphere cognitive abilities. (shrink)

This essay explores how it might be possible to recover a more pluralistic and therefore participatory understanding and exercise of the teaching office in the Christian Church by, first, briefly reflecting upon the historical backdrop to the emergence and development of the role of authoritative ecclesial teacher. Second, I identify some of the ecclesial fault lines and tensions that emerged in the modern and contemporary periods pertaining to teaching authority. Third, I raise the issue of the impact of such developments (...) upon the manner in which Christian churches have sought to offer teachings on ethical issues in recent times. Fourth, I explore, via an ecclesiological analysis that is both a comparative and ecumenical in nature, three visions for retrieving a more participatory and life-giving understanding of the teaching office and practice of the teaching function for our times. The visions explored come from a Reformed, Roman Catholic, and ecumenical standpoint: respectively, those of Richard Robert Osmer, Richard R. Gaillardetz, and Willem Visser 't Hooft. The final section offers some brief conclusions about the potential for truly ecumenical collaboration in moral discernment in the light of such considerations. (shrink)

Today’s textualist Supreme Court draws a bright line between essential “linguistic” interpretive canons and suspect “substantive” canons. This Article’s thesis is that the venerable linguistic/substantive dichotomy is false. We present the first empirical study of whether ordinary people (N = 1,520) understand rules in line with some of law’s substantive canons. The study supports that some substantive canons represent valid linguistic generalizations about how ordinary people understand rules’ meaning. For example, the presumption against retroactivity is usually justified by values like (...) fairness, but it also best reflects ordinary readers’ default understanding of rules’ meanings. -/- In an age of textualism, this argument has direct practical implications. Interpreters committed to the ordinary reader should reconsider whether rules that have been traditionally described as “substantive canons” might also be linguistic ones. The article’s analysis also puts pressure on textualists to better justify their recent embrace of purely substantive canons, like the new “major questions” canon. Most broadly, the Article makes progress on a longstanding philosophical debate about facts and values in interpretation. Beyond the exclusively linguistic canons and the exclusively substantive canons, there is an important but overlooked category: The linguistic and substantive canons. (shrink)
